Introduction

In compliance with the provisions of Article 10 of Law 34/2002, of July 11, 2002, of Information Society Services and Electronic Commerce, it is reported that the entity providing services is the company AtriaSFK, S.L. (hereinafter ATRIA Clinic), a company with Spanish nationality and registered office in Madrid, c/Alcalá 73 1º Izq-Dcha, 28009 Madrid, with Tax Identification Number B-42834135, registered in the Mercantile Registry of Madrid, Volume 41509, Folio 170, of its corporate page number M-735550.

Purpose

The purpose of these Terms of Use (hereinafter the Terms) is to regulate the access, navigation and use of the website (hereinafter the Portal, Web Portal, Website or Web Page), as well as other communication channels with the client (voice interfaces, etc.) of ATRIA Clinic. Access, navigation and / or use of the Portal, imply acceptance of all the stipulations provided in these Conditions, as well as the Privacy policy or Data Protection and the Cookies Policy.

There are, however, certain services and contents accessible through the Web Portal, subject to special conditions that may replace and/or complement the present Conditions.

User status

User shall be understood as the person who accesses, browses and uses the Web Portal, the services and/or the contents hosted therein.

The navigation, access and use of the Web Portal do not require prior registration, however, there are certain services offered through it, whose access will be necessarily conditioned to the registration and acceptance of particular conditions that will govern the referred service.

Access to the Web Portal by minors shall be understood to be expressly authorized by their parents, guardians or legal representatives, who shall be liable for the acts carried out by minors as Users of the Web in accordance with the applicable regulations.

Usage requirements

To access the Portal and the services offered, you will need a device that meets the requirements of hardware and software compatibility (which may vary over time) and Internet access. The User shall be aware that these factors may influence the performance of the Web Portal and/or the possibility of accessing the services offered therein.

ATRIA Clinic is not responsible for the impossibility of access or deficiencies in the functioning of the Web Portal and/or the services offered through it due to the use of inadequate devices, or due to Internet service interruptions derived from network saturation or any other reason.

Usage regulations

Service use: The User undertakes in all cases to use the Portal and its services in a diligent, correct and lawful manner, in accordance with the law, the Legal Notice, these Conditions (and/or those applicable in each specific case), regulations of use and instructions made known to the User, as well as with morality, generally accepted good customs and public order.

To this effect, it will refrain from carrying out any activity that is illicit, prohibited, or harmful to the rights and interests of third parties, or that in any way may damage, render useless, overload, deteriorate or impede the normal use of the services, computer equipment or documents, files and all types of content stored in any computer equipment ofATRIA Clinic, other users or any Internet user (hardware and software).

Access Control: the User will be able to access only to those resources of the information system to which he/she is authorized.

Temporary Files: lthe information stored in the Web Portal must be consulted on ATRIA Clinic’s systems, but ATRIA Clinic cannot be held responsible for the information that the User exports from these systems.

Condicitions of use: When the User is using the Web Portal, he/she shall be responsible for ensuring that the information he/she handles cannot be seen by unauthorized persons.

The User expressly agrees not to store, use, transmit or disseminate:

  • Cracks, program serial numbers or any other content that infringes the intellectual property rights of third parties.
  • Distribution of viruses through the Internet, worms, Trojans or any other destructive activity, such as saturation, mailbombing, etc. or denial of service attacks.
  • Activities that disrupt or interfere with the effective use of other people’s network resources.
  • The collection and/or use of personal data of other users without their express consent or in contravention of the provisions of the regulations on data protection.
  • Share the access codes provided (in the event that the same was registered as a User of a particular service that requires it) with another natural or legal person.
  • Destroy, alter, disable or in any other way damage the data, programs or electronic documents of ATRIA Clinic or third parties.
  • Obstructing the access of other users by means of massive and unjustified consumption of the computer resources through which ATRIA Clinic provides any of its services, as well as performing actions that damage, interrupt or generate errors in such systems.
  • Use the system to attempt to access restricted areas of the server, without proper authorization from ATRIA Clinic.

Intellectual and industrial property

The design, images, labels, distinctive signs, commercial name, brands, logos, products and services, etc. contained in the Web are protected by the Industrial Property Law and are property of ATRIA Clinic, and it cannot be understood that the use or access to the Web Portal and/or to the services provided therein, attributes to the User any right over the mentioned design, images, labels, distinctive signs, commercial name, brands, logos, products and services.

Likewise, the Web, its source code and the contents accessed through this site are Intellectual Property of ATRIA Clinic and/or third parties, without being transferred to the User in any case.

ATRIA Clinic is the owner or licensee of all rights over the content of the Web Portal and the services offered through it. The access to the Web or to its services does not grant to the Users any right or ownership over the intellectual or industrial property rights of the Contents it contains. The User acknowledges and accepts that its use is strictly prohibited, as well as its reproduction, communication and/or distribution, modification, alteration or decompilation, whether for personal, private and non-profit use or for commercial or lucrative purposes.

ATRIA Clinic reserves the right to take legal action against Users who violate or infringe intellectual and industrial property rights.

Service availability

The information, contents or services offered through the Web are those that ATRIA Clinic decides at any time and may vary over time. Therefore, there is no obligation on the part of the latter to keep the services available. However, Users will be informed when it decides to cancel the continuity of a certain service and the conditions for its cessation.

Also, ATRIA Clinic will be able to cancel the access to the services, total or partially, to those Users who do not comply with the present Conditions.

Warranty and liability of ATRIA Clinic

Although ATRIA Clinic uses systems that are compatible with most of the technologies on the market, it cannot guarantee the compatibility of the devices used by the User.

ATRIA Clinic does not guarantee the availability and continuity of the functioning of the Portal or the Services offered. Therefore, it shall be exempt from any liability arising from access to and use of the Web or the services offered through the same (performance failures, interruptions or delays in the operation of the Service, system or line failure, etc.), even if there is a failure or malfunction that causes damage to computer tools of third parties. In this sense, the User accesses the Web and the services under his sole responsibility.

The services offered through the Web Page comply with the provisions of the Spanish legal system.

ATRIA Clinic is released from any responsibility in case of improper use of the Portal and/or services by the User.

ATRIA Clinic will not be responsible in the event of unavailability of services due to force majeure or temporary suspension of services for technical reasons. Therefore, ATRIA Clinic will not assume any responsibility for damages or losses that may be suffered as a consequence of events that could not have been foreseen or that could not have been foreseen, or that were unavoidable, either by fortuitous event or force majeure.

ATRIA Clinic is not responsible for any failure, technical error, accident, breakdown, manipulation, interruption in the services or any other incident that may arise in products, equipment or technical services outside ATRIA Clinic whose use is necessary to access the services.

Although ATRIA Clinic has acted diligently and has adopted the necessary measures, according to the state of technology, to avoid possible breaches in the security of the Portal, the absolute impossibility of vulnerability of the adopted security measures cannot be guaranteed.

ATRIA Clinic is not responsible for the legality of other third party web sites from which the Portal can be accessed. ATRIA Clinic is also not responsible for the legality of other third party websites that may be linked or linked from this Portal.

ATRIA Clinic will try, as far as possible, to update and rectify the information hosted on its website. However, any liability for damages of any kind that may be due to the lack of truthfulness, accuracy, completeness and/or timeliness of the content transmitted, disseminated, stored, made available, received, obtained or accessed through the Web is excluded.

With regard to information and contents related to health, these are provided for information purposes only and ATRIA Clinic recommends the User to always act under professional medical advice.

The User assumes that in case of taking decisions based on the information provided in the Web, the responsibility will be exclusively his own, not being able to make any claim to ATRIA Clinic for the consequences of the decisions taken.

Content and conditions modifications

ATRIA Clinic may add new functionalities to the Website and/or modify the current Conditions. In that case, the update will be published on the Portal so that the User is aware of any changes. If the User does not agree with the new conditions, he/she will have a period of fifteen calendar days from the communication to terminate the contract by means of a reliable communication to ATRIA Clinic. If the above-mentioned period elapses without the User having stated anything to the contrary, this shall imply full acceptance of the new conditions.

Jurisdiction and applicable law

This Legal Notice shall be ruled and interpreted in accordance with Spanish law. Any controversy that may arise from the access or use of the Web Page shall be subject to the exclusive jurisdiction of the Courts and Tribunals of Madrid, without prejudice to the application of any mandatory provision to the contrary, in which case the content of the same shall apply.
